Terms of Service

These terms govern your use of LumaShift (the “Platform”, “we”, “us”). By creating an account, booking a session, purchasing a digital product, or otherwise using the Platform, you agree to these terms. If you don’t agree, please don’t use the Platform.

1. Who operates LumaShift

LumaShift is operated by Moovela Ventures (SSM Reg. No. 202603210826), a business registered in Malaysia as a sole proprietorship. Moovela Ventures is the legal entity you contract with when you use the Platform, book a session, or make a payment. Contact us at lumashift@outlook.com.

Because Moovela Ventures is a sole proprietorship (not a private limited company), it does not have the separate legal personality or limited liability that a Sdn Bhd would — see Section 10 for what that means for liability.

2. Eligibility

You must be at least 18 years old to create an account and make a purchase. If you’re between 13 and 18, you may use the free tools with a parent or guardian’s permission, but you’ll need a parent or guardian to make any purchase or booking on your behalf.

3. What LumaShift provides

Free tools: Career Quiz, Resume Analyzer, Job/JD Analyzer, LinkedIn Analyzer, Mock Interview, Salary Coach, Cover Letter Generator, Skill Gap Coach, and Cert Planner — each with a limited free allowance, then a usage cap per our pricing.
Coaching services: paid 1:1 sessions (resume review, mock interviews, career consultations, and similar) booked through the Platform and delivered live, typically via Google Meet.
Digital products: AI-generated and coach-validated reports (Career Snapshot, Job Match Report, Cert Roadmap, Interview Prep Pack, LinkedIn Rewrite, Resume Rewrite) delivered as a downloadable PDF.

4. AI-generated content — read this before you rely on anything the AI tells you

Most of what LumaShift produces — resume feedback, JD fit scores, interview questions and feedback, salary guidance, career quiz results, cert roadmaps — is generated by an AI model (currently Meta’s Llama 3.3 via Groq), not manually written or verified by a human for every output.

AI outputs are guidance, not guarantees. We don’t guarantee any outcome — not an interview, not a job offer, not a specific salary, not exam success.
AI outputs are not professional legal, financial, immigration, or employment-law advice. Salary/negotiation guidance in particular is directional market data, not a promise of what any specific employer will offer.
You’re responsible for reviewing and verifying anything AI-generated before you act on it — send it in a real application, quote it in a negotiation, or rely on it for a certification decision.
Where a product is explicitly marked “coach-validated”, a human coach has reviewed the AI draft before delivery — this doesn’t change the guidance-not-guarantee nature of the content, just who checked it.

5. Your account

You sign in via Google OAuth or a passwordless magic-link email — we don’t store passwords.
One account per person. Don’t share your login or create multiple accounts to bypass usage limits or the free-tier allowance — we may suspend accounts doing this.
You’re responsible for keeping your account email/Google login secure. Tell us immediately at lumashift@outlook.com if you suspect unauthorised access.
What we collect and how we use it is covered separately in our Privacy Policy — these Terms don’t repeat that.

6. Payment

Coaching sessions and digital products are paid via DuitNow or bank transfer to Moovela Ventures. Payment instructions are shown at checkout; your order is confirmed manually once payment is received — this typically takes a few hours, not instantly. Prices are in Malaysian Ringgit (MYR) unless stated otherwise.

7. Refunds

Digital products (Career Snapshot, Job Match Report, Cert Roadmap, Interview Prep Pack, LinkedIn Rewrite, Resume Rewrite) come with a 7-day no-questions refund from the date of delivery. Email lumashift@outlook.com from the email address on the order. We process approved refunds via DuitNow/bank transfer within 3 business days; your bank’s own settlement timeline is then out of our hands (typically 1–3 business days for DuitNow, longer for other transfer methods).

The 7-day window is calendar days. If delivery slipped past our promised SLA (2–10 minutes for AI-generated reports; 24h for coach-validated reports), the window starts from your delivery email, not the purchase timestamp.

Coaching sessions already delivered (the call happened) are not refundable. If you need to reschedule, use the reschedule option on your booking or contact your coach directly — rescheduling is handled case by case and isn’t guaranteed if requested very close to the session time. A session you paid for but that was cancelled by us or never delivered is fully refundable.

8. Intellectual property

LumaShift’s platform, branding, learning content, and the specific text of AI prompts are our property. Don’t scrape, resell, or republish them without permission.
What you submit — your resume, job descriptions you paste, quiz answers, profile details — stays yours. We use it only to generate your results and, where you’ve consented, to improve our service (see Privacy Policy).
Reports and content we generate for you (resume rewrites, career snapshots, etc.) are yours to use for your own job search and career purposes.

9. Acceptable use

You agree not to:

Use the Platform for anything illegal, or to submit content that’s defamatory, infringing, or harassing.
Attempt to bypass usage limits, scrape the Platform, or interfere with its normal operation.
Use the AI tools to generate content for someone else’s job application under false pretences (e.g. sitting a proctored assessment on someone’s behalf).
Reverse-engineer, resell, or white-label the Platform or its AI outputs as your own product.

We may suspend or terminate accounts that violate this section, with or without notice depending on severity.

10. Disclaimers & limitation of liability

The Platform is provided “as is”. We don’t guarantee it will be uninterrupted, error-free, or that any AI tool will produce accurate results every time — see Section 4.

To the maximum extent permitted by Malaysian law, Moovela Ventures’ total liability to you for any claim arising from your use of the Platform is limited to the amount you actually paid us in the 12 months before the claim arose. We’re not liable for indirect, incidental, or consequential losses (e.g. lost earnings from a job outcome, or costs from acting on AI guidance without independent verification).

Because Moovela Ventures is a sole proprietorship, these limits protect the business’s finances, not a separate corporate shield — nothing in this section is intended to exclude liability that cannot be excluded under Malaysian consumer protection law.

11. Indemnity

You agree to indemnify Moovela Ventures against claims arising from your misuse of the Platform, content you submit that infringes someone else’s rights, or your violation of Section 9 (Acceptable use).

12. Termination

You can stop using the Platform and request account deletion any time via lumashift@outlook.com or your data page. We may suspend or terminate accounts that violate these Terms. Sections that naturally survive termination (payment obligations already incurred, IP, liability limits, indemnity) continue to apply.

13. Governing law & disputes

These Terms are governed by the laws of Malaysia. Any dispute is subject to the exclusive jurisdiction of the Malaysian courts. Before filing a claim, please email us first — lumashift@outlook.com — most issues get resolved faster that way.

14. Changes to these Terms

We’ll bump the “Last updated” date above when these Terms change substantively. Material changes affecting your rights will be emailed to registered users. Continued use of the Platform after a change takes effect means you accept the updated Terms.
